These Terms of Service govern the use of the CiteTide service available at citetide.com.
The service is operated by Jan Brožíček, Company ID (IČO) 08764832, registered address Rižská 1492/2, 102 00 Prague, Czech Republic, email legal@citetide.com. The provider operates under the name “CiteTide”.
CiteTide is a web-based SaaS application that helps companies, entrepreneurs, agencies and individuals measure and improve the visibility of their brand, website or project in the answers of AI search engines and assistants, especially ChatGPT, Perplexity, Gemini and Claude. The user enters, in particular, a domain, brand name, competitors and monitored queries. The service regularly calls third-party APIs, analyses responses and displays measurements and recommendations.
The service provides analytics and recommendations. The outputs of third-party AI systems may change, may be inaccurate, incomplete or unavailable, and are not controlled by the provider. CiteTide does not guarantee any particular ranking, mention, brand visibility, traffic increase, business outcome or inclusion in the response of any AI system. Recommendations are not legal, financial, tax or technical audit advice.
Using the service requires registration by email and password. The user must protect their login credentials, provide accurate and current information and prevent unauthorised access to their account. The provider may suspend or restrict an account if there is suspected misuse, a security incident, non-payment or a breach of these Terms. The provider may send the customer operational and service emails related to the account and operation of the service, such as security notices or billing messages — see the Privacy Policy.
The service is intended primarily for businesses, companies, marketing agencies and creators using it in connection with their commercial activity. If the customer orders the service as a business customer or in the course of business activity, consumer-protection provisions do not apply, including the consumer’s 14-day right of withdrawal, unless mandatory law provides otherwise. If the customer acts as a consumer, consumer rights apply as set out in these Terms and applicable law.
The contract is formed by completing registration, activating a paid plan, confirming a subscription or otherwise expressly accepting these Terms within the service. The contract includes these Terms of Service, the Privacy Policy, the Cookie Policy and any special terms of a particular plan.
The service may be offered under a Free plan and paid Starter and Pro plans. The Free plan may be limited by features, number of projects, number of queries, measurement frequency or other parameters. Paid plans are charged monthly as recurring subscriptions through Stripe. Prices are stated in the ordering process, typically in USD. The provider does not store full payment-card details.
Paid subscriptions renew automatically for successive monthly periods until cancelled. The customer may cancel the subscription in their account or by another method stated in the service. After cancellation, the paid plan remains available until the end of the already-paid period, unless stated otherwise. Cancellation does not automatically create a right to a refund of a proportionate part of the price for the already-paid period, unless required by law or individual agreement.
If the customer is a consumer, they may have the right to withdraw from the contract within 14 days of its conclusion. CiteTide is a digital service supplied immediately after ordering. If the consumer expressly consents at checkout to the service beginning before the withdrawal period expires, then in the event of later withdrawal they may be required to pay a proportionate amount corresponding to the service provided until withdrawal, to the extent permitted by law. A consumer may withdraw by email to legal@citetide.com or through the online withdrawal function if available in the service. This section does not apply to customers ordering as business customers.
Questions, complaints and support requests may be sent to legal@citetide.com or another contact channel stated in the service. The provider will handle complaints within a reasonable time according to the nature of the request. Consumer rights are not affected.
The customer must use the service lawfully, enter only data they are authorised to use, not submit sensitive personal data or third-party personal data unless necessary, not compromise the security of the service, not circumvent plan limits and not use the service for unlawful, fraudulent, harmful or excessively burdensome purposes.
The customer acknowledges that the service uses third-party APIs, especially OpenAI, Anthropic, Google Gemini and Perplexity. Monitored queries, brand names, domains, competitors and related context necessary for measurement may be sent to these providers. The availability, speed, pricing, quality and content of responses from these APIs are not fully controlled by the provider.
The service, software, design, database structure, interface, documentation and know-how are protected by intellectual-property rights of the provider or its suppliers. The customer receives a limited, non-exclusive, non-transferable right to use the service for the duration of the account or subscription. The customer retains ownership of their input data and project data.
The customer is responsible for the accuracy, lawfulness and appropriateness of data entered into the service. The provider may use project data to provide the service, store results, calculate metrics, display recommendations, perform operational diagnostics and improve the service in aggregated or anonymised form, provided this does not breach the confidentiality of customer data.
The provider endeavours to operate the service reliably but does not guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance, updates, security measures, third-party outages, API limits or circumstances beyond the provider’s control. A specific SLA applies only if agreed separately.
The service is a supporting analytics tool. The customer remains responsible for their business, marketing and technical decisions. Towards customers who are not consumers, the provider’s total liability is limited to the amount paid by the customer for the service in the 12 months preceding the event giving rise to liability, unless the law requires otherwise. The provider is not liable for indirect damage, lost profit, loss of opportunity, reputational harm, changes in outputs of third-party AI systems or damage caused by misuse of the service, unless the law requires otherwise. This limitation does not apply where liability cannot be limited by law.
The customer may terminate their account through the service or by request to legal@citetide.com. The provider may suspend or terminate an account if the customer breaches these Terms, fails to pay, endangers the security of the service or uses it unlawfully. After termination, data will be deleted or anonymised according to the Privacy Policy and retention rules of the service.
The provider may change the service and these Terms, in particular due to changes in law, technical development, security, third-party API changes, prices or feature extensions. The customer will be informed of material changes by a reasonable means. If the customer disagrees with a change, they may terminate the subscription at the end of the current billing period.
These Terms are governed by the law of the Czech Republic. If the customer is a business customer, disputes will be resolved by the competent courts of the Czech Republic. If the customer is a consumer, this does not affect their rights under mandatory provisions of consumer-protection law. A consumer may also turn to the Czech Trade Inspection Authority as the body for out-of-court resolution of consumer disputes.
